According to Jeffrey Toobin, author of “The Nine: Inside the Secret World of the Supreme Court,” the pro-life crowd will have to wait for another appointment. Despite the flurry of talk about Roe vs. Wade being overturned, it’s safe to say that, for now, at least five of the nine Supreme Court Justices will continue to uphold the precedents of the court. Justices John Paul Stevens, Anthony Kennedy, David Souter, Ruth Bader Ginsburg, and Stephen Breyer are unlikely to waver in their previously expressed support for Roe v. Wade. The bad news for pro-choicers, he says, is that Stevens and Ginsburg will likely be the next two Supreme Court Justices to retire, making the upcoming Presidential elections pivotal for the future of abortion laws.
However, none of this appears that it will matter in the upcoming year. Instead, Toobin says, the big U.S. Supreme Court cases of 2008 will deal with: (1) the 2nd amendment and gun control, (2) another Guantanamo case, (3) whether or not the idea of an American voter ID is unconstitutional, and (4) whether or lethal injection of the blood is cruel and unusual punishment.
